State Challenges Pot Dispensary Ruling

As lawmakers weigh changes to the state’s medical-marijuana laws, the Florida Department of Health has appealed a circuit judge’s ruling that struck down a limit on the number of dispensaries that marijuana businesses can operate. 

Siding with Florida’s largest cannabis operator, a circuit judge for the second time struck down a law capping the number of dispensaries medical marijuana businesses can run. 

While lawmakers weigh whether to call a special session for medical marijuana, dispensaries are pushing ahead.  One grower is preparing to open its first retail outlet.

The Hillsborough County Commission is jumping ahead of the state legislature by creating a framework for medical marijuana dispensaries.

Florida has legalized medical marijuana. But one big question: Where will those dispensaries go? And how much control will local governments have to regulate medical marijuana?

Florida's Department of Health has granted its second dispensing authorization for medical marijuana and its location will be in Tampa.
